Through this pre-agreement, the creator of each series of photographs that have been submitted to the Tloupas PATH Awards competition explicitly and unconditionally declares and acknowledges that:<\/p>

A. GENERAL TERMS: <\/u><\/strong><\/p>

  1. The series of photographs that he has submitted to the competition, as a work of artistic creation, is original, i.e., it fully complies with the provisions of Articles 1, 2, 3, and 4 of Law 2121\/1993 “Intellectual Property, Related Rights, and Cultural Issues.” Specifically, it is clarified that “originality,” a concept not generally defined by the law, means the judgment that under similar conditions and with the same goals, no other creator, by logical assumption, would be able to create a work similar to it or one that shows a unique individuality or a minimal threshold of “creative style,” so that it stands out and differentiates itself from everyday works or other similar well-known works, simultaneously expressing something of the creator’s unique personality. <\/li>

    B. SPECIAL TERMS: <\/u><\/strong><\/p>

    1. He intends to assign to the Tloupas PATH Awards competition, in the event that he is selected as short-listed or as a winner, exclusively and only the use of his photographs and accepts that the Tloupas PATH Awards competition may use these photographs at its discretion, solely for promoting its purposes, as described on its website, and for promotional purposes related to the activities of the Tloupas PATH Awards.<\/li>
    2. Specifically, if his photographs are short-listed, the creator accepts that they may be used for the purposes of the relevant exhibition(s) of these photographs in the fall of 2025 or at a later time, at a location chosen by the organizers of the Tloupas PATH Awards competition, as well as for advertising the competition in local and national print and electronic media, on the competition’s social media, on the competition\u2019s website, in invitations to the exhibition of the awarded and short-listed photographs, in posters for the advertising of the exhibition, in catalogs for the needs of the exhibition, in banners, and other media deemed appropriate by the organizers of the Tloupas PATH Awards competition. It is explicitly emphasized that the above list is indicative and not restrictive, and no financial compensation will be provided for the use. <\/li>
    3. He intends to assign all the rights in the previous paragraph for the exhibition of the awarded and short-listed photographs, not only in the city of Larissa, but also in other cities of Greece that the organizers of the Tloupas PATH Awards competition may choose to hold the exhibition, with the same or different curatorial placement and display of the photographs.<\/li>
    4. He intends to make the necessary modifications to his photographs (e.g., resizing, enlarging, scanning, printing) exclusively and solely for the needs of the exhibitions organized by the Tloupas PATH Awards competition or consents to the organizers making such curatorial modifications exclusively and solely for the needs of the exhibitions (e.g., the manner of placement and display of the photographs during the exhibitions).<\/li>
    5. He certifies that the accompanying texts of the photographs are his own creation and not that of third parties. In the case that bibliographic references are used, the name of the author\/creator of those references will explicitly be stated. Furthermore, he agrees that if the organizer of the Tloupas PATH Awards competition deems that the submitted texts offend third parties or public sentiment, or may create issues for the competition, he has the right to ask the participant to modify them. In case of disagreement, his participation in the competition will be rejected. Finally, he agrees that the above-mentioned accompanying texts will be assigned to the Tloupas PATH Awards competition, including but not limited to, for posting on the competition’s website, publication in local or national print or electronic media, for the purposes of the exhibitions organized by the competition’s organizer, for the exhibition’s printed materials, and posters. <\/li>
    6. He acknowledges that the Tloupas PATH Awards competition and its organizer are not responsible if his name is omitted when the photographs are re-published by a third party, and that the Tloupas PATH Awards competition and its organizer are not obliged to compensate the creators in the case of re-publication of the photographs without their name, whether by the competition’s collaborators or third parties. In this case, the creator may demand recognition of his rights, the cessation of the infringement, and its prevention in the future solely from those responsible and not from the organizer of the Tloupas PATH Awards competition. <\/li>
    7. He acknowledges that for any claim by third parties related to his participation in the Tloupas PATH Awards competition, he is solely responsible and is obliged to compensate the organizer of the competition in case of damage to its objectives.<\/li>
    8. He certifies that for the assignment of the use of his photographs to the Tloupas PATH Awards competition, he does not expect any payment, compensation, or any other benefit.<\/li>
    9. He consents to the storage of his photographs and accompanying texts by the Tloupas PATH Awards competition for the purposes of future exhibitions in other cities of Greece, for as long as deemed necessary.<\/li>
    10. He acknowledges that in case his name is not listed on any of his photographs on the Tloupas PATH Awards competition\u2019s website, this has occurred solely due to an accidental error and he is obliged to inform the organizers immediately so they can correct this error.<\/li><\/ol>

      This pre-agreement for the assignment of the license for the use\/exploitation of photographs constitutes the full agreement between the parties and supersedes and cancels any previous draft, agreement, settlement, or understanding, whether in written or oral form. If any provision of this pre-agreement is deemed, in whole or in part, invalid or unenforceable for any reason, the validity of the remaining terms of this agreement is not affected.
